Terms of Use
Agreement to Terms. These Terms of Use ("Terms") govern access to seattlerentaboat.com and the online reservation-request process operated by Seattle Rent A Boat ("Seattle Rent A Boat," "Owner," "we," "us," or "our"). By using the site or affirmatively accepting these Terms during checkout, you agree to these Terms. A separately executed vessel rental, bareboat charter, PWC, safety, waiver, or dock-release agreement governs the actual rental and controls over these Terms to the extent of a direct conflict concerning the rental.
1. Eligibility and Site Use
You may use the site only for lawful purposes and only if you can form a binding contract. You must provide accurate, current information and may not impersonate another person, submit fraudulent rental requests, interfere with availability, probe or bypass security controls, scrape or overload the site, introduce malicious code, misuse payment mechanisms, or use the site to reserve inventory you do not genuinely intend to rent.
2. A Reservation Request Is Not an Approved Rental
Every rental request requires Brian's manual approval, without exception. Submitting a request and saving a card does not guarantee a vessel, date, price, captain, route, add-on, or rental. Seattle Rent A Boat may approve or decline a request based on availability, operator qualifications, safety, maintenance, weather/water conditions, payment status, documentation, legal requirements, suspected fraud or abuse, operational constraints, or other legitimate rental considerations.
3. Saved Payment Method; Approval and Rental Charge
When you submit a rental request, you authorize Stripe to securely save the selected payment method for the reservation. The rental charge is not processed merely because the request was submitted. If Brian approves the request, you authorize Seattle Rent A Boat and Stripe to charge the approved vessel rental price, selected add-ons, applicable taxes, and other charges affirmatively included in the approved checkout amount. If issuer authentication or another secure payment step is required, the reservation remains unconfirmed until that step is successfully completed and payment is confirmed.
4. Pricing and Taxes
Public vessel cards may display an hourly-plus price such as "$169/hr+" as a concise reference to current package pricing. The actual rental price is the server-calculated trip/package price for the selected vessel, duration, date adjustment, and add-ons shown during the request process and confirmed upon approval. Prices may change before a request is submitted. Applicable transaction tax is calculated through Stripe Tax or another configured tax mechanism and added or handled as displayed in the approved payment flow. A website display error does not require Seattle Rent A Boat to honor an obviously erroneous price; if an error materially changes the approved total, we will disclose the correction before proceeding where required.
5. Separate $1,000 Security Authorization
Every rental requires a separate $1,000 card authorization before vessel release. This is ordinarily a temporary hold rather than an immediate captured charge. It is normally placed approximately 48 hours before departure. If a rental is requested and approved within approximately 48 hours of departure, the rental charge and security authorization may be processed in the same operational sequence immediately after approval. The vessel will not be released unless the required security authorization is active and otherwise sufficient for the scheduled rental.
The $1,000 authorization is not a liability cap, damage waiver, insurance policy, estimate of maximum loss, or advance agreement that every dollar will be charged. After the rental, Brian may release the full authorization or capture documented authorized deductions and release the uncaptured remainder in accordance with payment-network functionality and applicable law.
6. Authorized Security-Authorization Deductions
Subject to the rental agreement, applicable law, and payment-network rules, you authorize Seattle Rent A Boat to document and settle lawful rental-related amounts from the security authorization, including:
- an agreed or customer-authorized captain fee collected by Seattle Rent A Boat where applicable;
- fuel or refueling amounts;
- customer-requested or approved rental extensions;
- late return fees and direct operational consequences as permitted by the rental agreement;
- cleaning beyond ordinary use;
- missing, lost, or damaged items;
- damage to the vessel, engine, propulsion system, upholstery, electronics, safety equipment, accessories, or any Seattle Rent A Boat add-on, equipment, dock-related item, or other property;
- towing, recovery, salvage, impound, citations attributable to the renter, loss of use, diminished value where legally recoverable, collection costs, and other documented lawful charges authorized by the rental agreement.
If you elect during the rental to have fuel, an extension, a captain-related amount, or another agreed item satisfied from the security authorization, Brian may record that election while keeping the full hold in place until final settlement. This protects the remaining security purpose of the authorization. At final settlement, documented deductions may be captured together and the uncaptured remainder released. If lawful documented charges exceed $1,000, you authorize Seattle Rent A Boat to charge the saved payment method for the excess as authorized by the rental agreement and applicable law. We may preserve customer approvals, photographs, video, invoices, estimates, meter or engine-hour readings, dock records, official reports, and other reasonable evidence supporting an adjustment.
7. Cancellation and Refund Policy
Unless a booking-specific written term states otherwise: (a) cancellation more than 30 days before departure is eligible for a 100% rental-payment refund; (b) cancellation 14 through 30 days before departure is eligible for a 50% rental-payment refund; and (c) cancellation fewer than 14 days before departure is non-refundable. Processing/issuer posting time is controlled by the applicable financial institutions. Rescheduling is not guaranteed. Weather alone does not create a refund or rescheduling right unless Seattle Rent A Boat expressly agrees or applicable law requires otherwise.
8. Owner Cancellation, Safety, Maintenance, and Substitution
Seattle Rent A Boat may refuse, cancel, delay, restrict, substitute, or terminate a rental when reasonably necessary because of maintenance, mechanical condition, unsafe weather or water, governmental restriction, marine-event conditions, qualification concerns, suspected impairment, nonpayment, failed security authorization, incomplete documents, capacity or route issues, fraudulent conduct, or other safety or operational concerns. If Seattle Rent A Boat cancels before possession for reasons not caused by the renter and cannot provide an accepted substitute, amounts collected for the unavailable rental will be refunded except where a different lawful remedy applies.
9. Captains and Bareboat Arrangements
Where a trip is structured as a bareboat/demise charter, the charterer must retain the lawful possession, command, control, and crew-choice rights required for that arrangement. Seattle Rent A Boat does not employ or control the charterer's captain merely because Brian supplies contact information. The charterer may reject suggested contacts, select any independently qualified captain, contract with that captain directly, and direct or dismiss the captain subject to safety and law. Any captain fee collected or documented by Seattle Rent A Boat must reflect the actual lawful arrangement and the renter's authorization. The separately signed charter/rental agreement controls operational responsibilities.
10. Operator Qualification and Safety
Only disclosed and approved operators may operate a vessel. Renters and operators must satisfy applicable age, boater-education, PWC, sobriety, safety-checklist, equipment, capacity, and operating requirements. No vessel is released until required payment, security authorization, agreement signatures, and dock-release conditions are complete. Seattle Rent A Boat may refuse operation by anyone reasonably believed to be impaired, unsafe, unqualified, or noncompliant.
11. Customer Information and Electronic Records
You agree that information submitted through the site is accurate and authorize electronic records, signatures, notices, agreements, receipts, and booking communications. Transactional communications are sent by email. Call/text support through (206)-552-0868 is a manual business communication channel; the site does not promise automated SMS. You are responsible for maintaining access to the email address and phone number supplied for the reservation.
12. Privacy
Our Privacy Policy describes information practices related to the website and rental operation and is incorporated into these Terms by reference for notice purposes. Nothing in these Terms is intended to waive a privacy right that cannot lawfully be waived.
13. Intellectual Property
The site design, branding, Seattle Rent A Boat name and logo, original text, photographs owned by Seattle Rent A Boat, booking interfaces, and other protected material are owned by Seattle Rent A Boat or used with permission and are protected by applicable intellectual-property law. You may use the site for personal rental-shopping and transaction purposes but may not reproduce, republish, sell, exploit, remove proprietary notices from, or create misleading derivative commercial uses of protected content without permission.
14. Third-Party Services and Links
Stripe, email providers, hosting providers, maps, marketplaces, and other third-party services operate under their own terms, systems, availability, and privacy practices. Seattle Rent A Boat is not responsible for a third party's independent outage, website, security, policy, or content, but remains responsible for its own obligations that cannot lawfully be delegated.
15. Website Availability and Disclaimer
The website and online tools are provided on an "as available" basis. To the maximum extent permitted by law, Seattle Rent A Boat disclaims implied warranties relating solely to website availability, uninterrupted access, or error-free operation. This section does not disclaim any warranty, duty, or remedy that cannot lawfully be disclaimed and does not replace the representations expressly stated in a signed rental agreement.
16. Limitation of Liability for Website Use
To the maximum extent permitted by applicable law, Seattle Rent A Boat will not be liable for indirect, incidental, special, exemplary, or consequential damages arising solely from inability to access or use the website, except to the extent such limitation is prohibited by law. Liability arising from the actual vessel rental, personal injury, property damage, maritime activity, or signed rental agreement is governed by the applicable rental documents and law, not by this website-only limitation.
17. Indemnity for Site Misuse
To the maximum extent permitted by law, you agree to indemnify Seattle Rent A Boat from third-party claims, losses, and reasonable costs arising from your fraudulent or unlawful misuse of the website, intentional interference with booking inventory or security, unauthorized use of another person's payment method, or material violation of these Terms. This provision does not require indemnification for Seattle Rent A Boat's own conduct to the extent such indemnification is prohibited by law.
18. Chargebacks and Payment Disputes
If you believe a charge is incorrect, contact Seattle Rent A Boat promptly so the underlying record can be reviewed. Nothing here limits a lawful right to dispute a card transaction. You agree not to knowingly submit false information in a chargeback or payment dispute. Seattle Rent A Boat may provide the payment processor or issuing bank with the accepted Terms, rental agreement, electronic-signature records, communications, condition evidence, itemized charges, customer elections, and other relevant transaction documentation.
19. Governing Law; Maritime Law; Venue
These website Terms are governed by Washington law without regard to conflict-of-law principles, except that applicable federal maritime law controls where it lawfully applies to a particular maritime issue. Subject to any controlling maritime, federal, small-claims, or other mandatory jurisdiction rule, the parties consent to state or federal courts located in King County, Washington for disputes arising from these Terms. The separately signed rental agreement may contain additional lawful dispute provisions applicable to the rental itself.
20. Changes; Versioning
We may update these Terms prospectively as the site, operations, vendors, or law change. The effective date and version above identify the current Terms. Material changes do not retroactively rewrite a completed transaction except where the parties lawfully agree or law requires. The Terms version affirmatively accepted during checkout may be preserved with the booking record.
21. Severability; No Waiver; Entire Website Terms
If a provision of these Terms is found unenforceable, it will be enforced to the maximum lawful extent or severed while the remainder remains effective. Failure to enforce a provision is not a waiver. These Terms and the Privacy Policy constitute the agreement concerning use of the website and reservation-request interface; the separately executed rental/charter/PWC/safety documents constitute the controlling agreement concerning the actual vessel rental where applicable.
